Using your own devices


The legislation applies to any information recorded in relation to your work, on any device, even if the device belongs to you personally.

This includes information created on personally owned electronic equipment like:

Personal computers
Personal laptops
Personal tablets
Personal mobile phones
Any other personal recording device

This includes any of the following sent about anything to do with your work.

It does not matter when the information is sent. It includes things like:

Sending email
Sending text messages
Sending voice recordings
Sending video clips
Sending photo images

You must abide by the legislation when sending emails, text messages, video clips, photos, voice recordings or other information from your personal devices.

Any record that is created in relation to your work is the intellectual property of your employer.

If you leave your organisation, you must not retain any confidential information. 

You must ensure you do not hold or can access any confidential information on your personal devices. If you keep sensitive personal data, this is reportable to the Information Commissioner’s Office (ICO) and may be a breach of confidentiality. You should report any concerns immediately to your employer (or ex-employer if you have left).
