5. How the law relates to risk assessment

Under the Management of Health and Safety at Work Regulations 1999 (MHSWR), the minimum we must do is:

  • Identify what could cause injury or illness in your workplace (hazards)
  • Decide how likely it is that someone could be harmed and how seriously (the risk)
  • Take action to eliminate the hazard, or if this is not possible, to control the risk.

Assessing risk is just one part of the overall process used to control risks in the workplace.

This involves looking at the likelihood and the severity of harm being caused, then putting appropriate control measures in place. Control measures are the things we put in place to reduce the risk and prevent harm. These sections follow the 5 principles of risk assessment.
