
If there is any doubt about whether an individual is able to make an informed decision, there needs to be an assessment under the MCA. The decision does not need to be something you would personally think of as sensible.

The MCA might seem a bit daunting. All you need to do is keep asking yourself…
“Does this person have mental capacity to make this decision at this time?”
If you believe they do, you carry on.
If you believe they do not, you need to ask for a MCA assessment.
If this process is not followed, there could be the legal proceedings and claims for compensation against your employer. You may be subjected to disciplinary procedures which could affect your employment.
